Welcome to The Beauty Exchange (“we”, “us”, “our”). The Beauty Exchange is a peer to peer New Zealand based online marketplace. We provide a platform for facilitating sales by allowing vendors and purchasers (“users”) to list and purchase qualifying products. 

By viewing and using The Beauty Exchange website (“our website”) you agree to these terms and conditions without qualification. If you do not agree to be bound by these terms and conditions, you must stop accessing and using our website. We reserve the right to change these terms and conditions at any time by notifying users of the existence of the amended terms and conditions through our website. By continuing to access our website, you agree to be bound by the amended terms and conditions.

  1. Privacy policy and personal information

Registration and use of the services on our website requires you to provide personal information. We maintain a privacy policy here. You consent to the release of your personal information to us and to third parties in connection with the uses contemplated by the privacy policy.   1. Registration and accounts 

By registering on our website you confirm that: 

  1. You are at least 18 years old and capable of entering into a binding legal agreement;
  2. You are a resident of New Zealand (unless agreed to by us prior to registration);
  3. All information provided is accurate and up to date including contact details.

By registering on our website, you consent to receiving marketing, promotional and other material by way of electronic messages from us. You will ensure that all usernames and passwords required to access our website are kept secure and confidential and you will notify us immediately of any unauthorised use of your password or any other breach of security. You must not transfer your account to another user or maintain more than one account with us without our consent. 

We may, at our sole discretion, suspend or terminate your account and limit your access to our website.

In order to utilise our website and services:

      1. You must enter information required to open an account by following the registration process set out on the website; and
      2. You must satisfy our other anti–money laundering checks where required under the Anti Money Laundering and Countering Financing of Terrorism Act 2009 (AML/CFT Act) and other registration criteria including undergoing verification checks to confirm your identity.
  1. Users outside New Zealand

Our website is operated by The Beauty Exchange from New Zealand. The information on our website may not be appropriate or available for use in other jurisdictions. If you choose to access our website from a jurisdiction other than New Zealand, you do so at your own risk and you are responsible for compliance with any applicable laws of that jurisdiction.

  1. Marketplace Rules

Vendors agree and warrant that they hold legal title to any items listed, be , and to follow our platform rules and comply with these terms and conditions. Any item listed for sale on The Beauty Exchange must be in the vendor’s possession at the time the item is listed. 

Vendors that are “in trade” for the purposes of the Fair Trading Act 1986 must disclose this on all listings, and on their profile and must, where applicable, comply with the Fair Trading Act 1986 and the Consumer Guarantees Act 1993.  

Vendors agree that they are responsible for the GST portion on the sale of their listings, where applicable. The Beauty Exchange is not responsible for returning GST on any transaction facilitated by our website. 

Purchasers are required to read listing details, including item descriptions carefully. Purchasers are deemed to have accepted the listed condition upon purchase. 

The Beauty Exchange disclaims all liability in respect of the stated condition or authenticity of products listed by vendors. 

  1. Qualifying products

Vendors may list genuine, resale-friendly beauty products including: 

      1. New, unopened, and unused skincare (e.g. cleansers, moisturisers, serums);
      2. New, unopened, and unused makeup (e.g. lipstick, foundation, palettes);
      3. New, unopened, and unused haircare (e.g. shampoo, conditioner, masks);
      4. New, unopened, and unused body care (e.g. lotions, scrubs, deodorant);
      5. New, unopened, and unused beauty tools (e.g. facial rollers, hairbrushes);
      6. New, unopened, and unused fragrances (must be sealed in original packaging);
      7. New, unopened, and unused nail products (e.g. polish, tools – sealed only);
      8. New, unopened, and unused beauty accessories (e.g. makeup bags, headbands).
      9. New, unopened, and unused hair tools (and, where applicable, permitted used hair tools) (e.g. hairdryers, straighteners, curlers). Hair tools must:
        1. comply with New Zealand electrical safety regulations and are designed for New Zealand outlets and voltage;
        2. be in excellent working condition with no faults or damage;
        3. if used, hair tools must be lightly used and comply with paragraphs 5(i)(i)-(iv) and must have been thoroughly cleaned with antibacterial cleaner (“lightly used” means the product or tool is in as-new condition with no signs of wear or damage to the tool surface; the tool has been removed from its original packaging and tested;”  ]); 

(“permitted used hair tools”)

        1. if used, hair tools must be listed with clear, original photos showing power cord, plug and tool surface. Any marks or manufacturer defects must be clearly shown in photos and must be noted in the item description If new, tools must be sealed in original packaging.

All products listed for sale on The Beauty Exchange must be of acceptable quality, be fit for purpose, match their description, and be delivered in good condition. 

We do not allow listings that may pose a health risk, violate brand rights, or breach New Zealand laws or regulations. The following items are deemed to be prohibited items: 

      1. Expired products;
      2. Samples or products marked “not for resale”; 
      3. Medical-grade or prescription-only products (e.g. retinoids, medicated cream, injectables);
      4. Products requiring cold chain storage;
      5. Counterfeit or inauthentic goods;
      6. Broken or damaged tools;
      7. Products showing evidence of tampering to seals or packaging.

5A   Gently Used Beauty Products

Where permitted, vendors may list certain gently used beauty products. All gently used products must meet the following standards:

    1.    Fill level: Products must be at least three-quarters (¾) full at the time of listing.

    2.    Strict exclusions: Products applied directly to the face may not be listed in gently used condition. This includes (without limitation) mascara, eyeliner, eyeshadow, lipstick, lip gloss, and similar items. Jarred products that require dipping fingers directly into the product (e.g., moisturisers, balms, masks in open pots) may not be listed in gently used condition;

    3.    Hygiene: All gently used products must be thoroughly cleaned prior to listing, including exterior surfaces, lids, pumps, and packaging.

    4.    Condition: Gently used products must be in excellent condition, with no cracked or shattered powders, broken packaging, leaking components, or damaged containers.

    5.    Accuracy: Vendors must provide clear, accurate photos of the actual item, showing condition and remaining volume.

    6.    Compliance: The Beauty Exchange may remove, hide, or delete any listing at any time where a product does not meet these standards, appears unsafe or unsanitary, or is otherwise in breach of these Terms.

All products listed for sale on The Beauty Exchange must be of acceptable quality, be fit for purpose, match their description, and be delivered in good condition.

5A.3 Cleaning Expectations

All gently used products must be presented in a clean and hygienic condition. Vendors are responsible for ensuring exterior packaging, lids, pumps, and applicators (where applicable) are free from visible residue, dust, or buildup. Products must not show any signs of contamination. The Beauty Exchange may remove any listing that does not meet these hygiene standards.

6. Payments and Fees

All payments on The Beauty Exchange are processed via our secure third-party payment provider, Stripe Connect. Payouts are typically made 7 days after an order is placed, depending on Stripe’s processing schedule. This time allows for any payment or order issues to be addressed.

Sellers are encouraged to ship orders within 24–48 hours of sale and must mark the order as fulfilled via their Webkul dashboard, including a valid tracking number.

Shipping costs are calculated at checkout based on national courier rates using NZ Post courier bags, which include tracking. It is the responsibility of both the buyer and seller to ensure that shipping is arranged and the correct courier bag size is selected during the listing and checkout process.

If the actual shipping cost exceeds the amount calculated at checkout, The Beauty Exchange is not liable for any additional charges. Any discrepancies or shortfalls in shipping costs must be resolved between the buyer and seller.

The Beauty Exchange disclaims all liability for delayed payments, errors, or disruptions caused by Stripe or any third-party payment providers.


  1. Returns and Refunds

Returns and refunds are at the discretion of the vendor. The Beauty Exchange is not responsible for managing returns or refunds between vendor and purchaser (“the parties”). Vendors are responsible for managing return requests, providing return shipping details, inspecting returned products, and issuing refunds to the buyer where appropriate. 

Vendors must, where applicable, comply with the Fair Trading Act 1986 and the Consumer Guarantees Act 1993.

The Beauty Exchange is a peer-to-peer marketplace that facilitates private sales between individual users. As such, the legal principle of caveat emptor (“let the buyer beware”) applies to all transactions. Buyers are responsible for ensuring they are satisfied with the item’s condition, authenticity, and suitability prior to purchase, as they would with any second-hand or private sale.

The Beauty Exchange is not a party to the transaction and does not assume liability for the condition of products listed or sold. We do not offer or guarantee refunds for items sold through the platform, except where required by law. If a dispute arises, we may attempt to facilitate communication between the parties, but we are not obligated to refund buyers on behalf of sellers or pursue reimbursement from sellers. The parties agree to resolve such matters in good faith as between themselves. 

  1. Copyright and trade marks

We own copyright in the contents of our website. No part of our website may be distributed or copied for any commercial purpose and you are not permitted to incorporate the material or any part of it in any other work or publication (whether in hard copy, electronic or any other form) without our prior written consent. You may not frame any part of our website material by including advertising or other revenue generating material. Further, you may not remove or alter any trade marks or logos that appear on any material on our website.

Vendors are responsible for ensuring that all items listed comply with applicable laws and do not violate third-party rights. If you believe a listing violates any intellectual property laws, including but not limited to counterfeit items, replicas or anything that closely resembles copyrighted designed, you may submit a request to review any offending listing(s) by contacting us at hello@thebeautyexchange.co.nz. 

The following is strictly prohibited on The Beauty Exchange:

      1. Counterfeit or replica products;
      2. Items marked “not for resale” by the original manufacturer;
      3. Unauthorised use of trademarked names, brand logos or copyrighted promotional material;
      4. Product descriptions or imagery copied from other websites without permission;
  1. Advertising

Any products listed for sale on our website must comply with the Advertising Standards Code (“Code”). We reserve the right to remove any listings that do not comply with the Code and any non-compliance may result in suspension or termination of a user’s account without notice. 

  1. Exclusion of liability

To the fullest extent permitted by law, we exclude all liability for any loss or damage that results from your use of our website and any services we provide, including from all express and implied warranties and representations. We will not be responsible for errors or misstatements or be liable, whether in contract, tort (including negligence) or otherwise, for any loss or damage however caused (including indirect, consequential or special loss or damage, or loss of profits, loss of data, loss of anticipated savings or loss of opportunity). 

If you are a consumer using our website for non-business activities then nothing in these terms and conditions is intended to abrogate any rights you might have under the Consumer Guarantees Act 1993 (if any). 

  1. Indemnity

You will take all necessary action to defend and indemnify us and our directors, employees and agents against all costs, expenses and damages incurred in connection with any claim brought by a third party against us that arise from a breach by you of any of these terms and conditions.

  1. Entire agreement

These terms and conditions in conjunction with our privacy policy form the entire agreement between us and you relating to our website and your use of the services.

  1. General provisions

If at any time we do not enforce any of these terms or conditions, or grant you time or any other indulgence, we will not be construed as having waived that term or condition or our rights to later enforce that, or any other, term or condition. 

Further, if any part or provision of these terms and conditions is considered to be invalid, unenforceable or in conflict with the law, that part or provision is deemed to be modified by a provision which, as far as possible, accomplishes the original purpose of that part or provision. The remaining terms and conditions will continue to be binding on the parties. 

These terms and conditions are governed by and will be construed in accordance with the laws of New Zealand and you submit to the exclusive jurisdiction of the courts of New Zealand.
